Unfair Competition

Unfair competition gives rise to liability on the basis of Article 1382 of the Civil Code which provides that ‘any action by an individual which causes damage to another makes that individual liable for reparation’

Unfair competition therefore means all actions or activities by one competitor which are against the law or which are done intentionally or negligently in such a way as to prejudice other competitors.

In other words, it encompasses all acts which do not correspond to the rules of fair competition.
