Data retention refers to the obligation bestowed upon those responsible for processing personal data to retain and conserve it efficiently and securely.

Personal data has an expiry date and therefore it is the responsibility of those in charge of processing it to give each file a reasonable length of retention according to what type of file or data it is.

Furthermore, the French Penal Code makes clear that it is an offense to retain data for longer than the original declared length of time. The punishment is 5 years in prison and a fine of €300,000.
