For certain types of personal data, prior authorization is required by the French Commission for IT and Liberties (CNIL – Commission Nationale de l’Informatique et des Libertés) before processing it. Such prior consent is needed for files which are either sensitive or at risk such as:

  • Sensitive data such as race or ethnic origin, philosophical, political, trade unionist and religious opinions, sexual orientation or health. Processing this type of data is justified on public interest grounds when the data remains anonymous for a short period of time;
  • Biometric data relating to digital fingerprints, contours of the hand, iris of the eye etc.;
  • Genetic information such as DNA;
  • Criminal convictions record or prior detention records;
  • Social security number (except for public authorities which are authorized to use this data);
  • Data relating to comments or observations regarding an individual’s social problems;
  • Statistical information from the French National Institute of Statistics and Economic Studies (INSEE);
  • Information likely to deprive the individual of a right, service or contract;
  • Files with distinct purposes or which correspond to distinct public interests;
  • Medical research;
  • Information relating to the evaluation of care services;
  • Information which is sent to countries outwith the EU and whose level of security and protection cannot be guaranteed.
