A design can be transferred to a third party under Article L.513-2 of the Intellectual Property Code. This provision states that ‘the registration of a design gives the holder an industrial property right which can be transferred or licensed’.

The transfer of the design is a contract whereby the rights holder, the ‘Transferor’, transfers the proprietary rights in this title to a third party, the ‘Transferee’ who will then be given the rights related to the transferred title.

The transfer contract must be recorded at the National Register of Trademarks otherwise third parties are unable to bring claims against it.
