Trademark Action

A trademark action is provided for in Article L.712-6 of the Intellectual Property Code.

This action is open to all third parties who consider that a title over industrial property has been obtained through fraud or through violation of the obligations set out in legislation or international conventions.

The period of prescription within which to bring a claim is three years from the date of publication of the registration request unless the person registering it acted in bad faith.
